These General Conditions of Sale exclusively govern the relations between the Company DPAN and the Customer wishing to place an order on the Website www.comptoirducabriolet.com of the DPAN brand.

Ordering by Internet:
When visiting the Website www.comptoirducabriolet.com, the Customer chooses the desired items (each product sheet contains the detailed description, price and availability) and adds them to his basket after indicating the desired quantity.
After having selected all the desired items, the Customer accesses his basket where he is invited to choose his place and method of delivery and indicate his method of delivery. payment.
The Customer then identifies himself or creates his Customer Area.
At the end of this step, the Customer is invited to validate his order.

Securing of payments:

Parcel control:
In the event of a delivery incident (damaged parcel, missing products, rescotched parcel, etc.), the Customer must note his reservations on the delivery slip and have the carrier sign (keep a duplicate of the document), and / or, if applicable, refuse the package.

If the package is delivered without signature, the Customer must report the damage to the carrier by registered mail with acknowledgment of receipt within 3 working days.

7 - Right of withdrawal

There is no right of withdrawal for the Professional Client for contracts concluded at a distance understood as contracts concluded without the simultaneous physical presence of the parties. The following paragraphs, the subject of which is the right of withdrawal, only concern the private customer.

The private customer has the right to withdraw from this contract without giving any reason within 14 days. The withdrawal period expires 14 days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the last good.

Exercise of the right of withdrawal :

Consequences of the right of withdrawal:

DPAN will proceed with the reimbursement using the same means of payment as the one that the Customer will have used for the initial transaction, unless expressly agreed by a different means; in any case, this reimbursement will not incur costs for the Customer. DPAN may defer reimbursement until it has received the goods or until the Customer has provided proof of shipment of the goods, the date chosen being that of the first of these facts. The Customer is only liable for the depreciation of the good resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of this good.

Exception to the right of withdrawal:
In accordance with article L.121-21 of the Consumer Code, the buyer has a right of withdrawal for 14 clear days following receipt of the goods.

The exercise of the right of withdrawal is excluded for the following contracts:
- contracts for the supply of goods made to the consumer's specifications or clearly personalized;
- contracts for the supply of goods liable to to deteriorate or expire quickly;

Return costs are the responsibility of the Customer.

Beyond this period, no item will be returned, exchanged or refunded.

8 - Returns

For all parts with a defect, an exchange will be quickly made or a credit note of their value, excluding postage and packaging costs after expertise in the premises of the Company.

The returns of Defective parts must be made within a maximum period of 14 days from the date on which the Customer has communicated his decision to withdraw.
Outside the withdrawal period, the Customer must not return any parts without having contacted DPAN beforehand to obtain a return authorization. The customer will thus receive all the useful instructions so that this return is carried out in the best conditions.

The Customer is invited to check the correspondence of the parts as soon as they are received, particularly in the event of restoration of a vehicle for which the parts are not necessarily fitted immediately.

The bodywork parts to be painted must be tested on the vehicle before painting: there will be no recovery of painted parts.

In any case, DPAN does not accept returns sent against reimbursement, or postage due, or poorly packaged.
Returns are limited to parts in perfect condition, clean, returned in their original packaging.
For orders to Professional Customers, no product can be returned without the prior agreement of DPAN.


If DPAN is accepted, the port is the responsibility of the Customer.

Do not remove the serial number label located on the inside of the convertible top: the absence of a label will not give rise to a complaint.

No coverage for the following elements of a soft top: tears, discoloration of the topcoat and / or thread, parts and accessories installed by the dealer and / or purchaser, closures zipper and fasteners, discoloration or cracking of plastic windows ...

9 - Guarantee

The Customer benefits from the legal guarantee against hidden defects and conformity defects on all the products delivered to him. In addition, some of the products benefit from the contractual warranty granted by the manufacturers, the terms then being specified on the warranty cards.

As part of the legal warranty against latent defects and defects in conformity , the Company's liability is limited to the starting value of the parts. The Company assumes no direct responsibility for damages due to the use of the products. The Company also assumes no responsibility for work such as: dismantling and / or installation, diagnostics and appraisals, loss of use of the vehicle, loss of time, disturbances or any other consequent expense. There is no warranty for special competition parts.

10 - Responsibilities

The Company cannot be held responsible for any damage caused directly or indirectly to any component not invoiced by it. In particular when the failure of one of these parts is caused by other neighboring components or unsuitable handling.

The products may be resold according to their destination. However, the Company cannot be held responsible for the failure or malfunction of the products in the event of resale by the buyer to its own customers.

The same goes for Approvals: Certain parts, apart from original replacement parts, do not benefit from an approval on French territory. All competition parts, for example: camshaft, exhausts, large brake kit, large displacement kit, etc. must be used on a racing circuit, and under the full responsibility of the buyer who must warn, if necessary, his own customers.

The Company cannot be held responsible for any immaterial damage such as loss of customers, loss of turnover, loss of production, margin, action taken by a third party against the Professional Client or condemnation thereof.

11 - Soft top reception check

1 - CHECK RECEPTION WITHIN 48 HOURS:
- Make sure you have received the correct product. Present the top on your old top
and make sure that the product is the right size and with the same features
as the top in place.
We remind you that no article presenting traces of glue or traces of
installation will not be taken up.
- Unfold the hood and let it relax in a temperature close to 20 °.
- If the hood does not have all the accessories that the original soft top take into account when reassembling.


2 - CHECKING THE STATE OF THE CLOSING HANDLES:
- Check that your handles are not split:
Indeed when fitting the new soft top, powering up is always difficult
and requires heavy pulling on the handles. This traction will decrease very quickly
when the soft top has taken its place.


3 - ELECTRIC COVERS:
BEFORE DISASSEMBLY
- Check that the system is working perfectly, that the oil level is satisfactory and that the
battery is fully charged.
BEFORE REASSEMBLY (soft top removed)
- Check the operation of the roll bar.
- Clean and lubricate all the pins.
- Change all the rubber bands that are loose.
- Check that the various hoops fold normally in the convertible top box.
- If necessary, change all the straps.
If you do not respect these points, the hoop may hole the convertible top.

12 - Industrial property

The plans, diagrams, specifications, recommendation documents, catalogs, brochures, photos and instructions, patents, product listing, forms of packaging, remain the property of DPAN.
Consequently, the Customer is prohibited to make any distribution or reproduction without the prior consent of DPAN.

The illustrations, photos, drawings, and page reproduced on the Comptoirducabriolet.com site and illustrating the products presented have no contractual value. Consequently, DPAN cannot, under any circumstances, be held responsible for any errors that may have crept into the catalog.

13 - Retention of title

The delivered products remain the property of the Company until full payment of the price of the order.

14 - Risk transfer

The risk of deterioration or loss of the goods will be transferred when the Customer takes possession of the goods delivered or when the goods are handed over to a carrier appointed by him, other than one of those offered on the Site Internet www.comptoirducabriolet.com.

15 - Litigation

These General Conditions are subject to French law. In the event that one of the clauses of this contract is null and void by a change in legislation or regulation, this can in no way affect the validity and compliance with these General Conditions of Sale.
The language of the contract is French.

In accordance with the Data Protection Act & Freedoms of January 6, 1978, the Customer has the right to access and rectify personal data concerning him: the information requested is necessary for the processing of his order.
